These terms and conditions ("Agreement") govern the use of Services provided by Krti Technologies Private Limited ("Provider") on Cloud, Hybrid or On-premise ("Cloud Services" "Service") to the customer ("Customer"). These terms and conditions shall form an integral part of the accompanying Service Request Form (“SRF”). By using the Cloud Services, Customer agrees to be bound by these terms and conditions.
The Cloud Services offered by Provider include the provisioning and maintenance of services hosted on the cloud.
Customer is granted a non-exclusive, non-transferable right to access and use the Cloud Services during the subscription period. Customer agrees to comply with all applicable laws and regulations while using the services.
Customer agrees to pay the fees specified by Provider for the selected Cloud Services. Fees are payable in advance and are non-refundable unless otherwise stated in the refund policy.
a. Refund Policy: If Customer is not satisfied with the Cloud Services within the first 7 days of the new subscription , a refund may be requested. The refund will be subject to any applicable deductions and will be processed within a reasonable time.
b. Cancellation Policy: Customer may cancel the Cloud Services at any time by providing written notice to Provider. Upon cancellation, Customer will no longer have access to the services, and any unused portion of the subscription fees will not be refunded.
Provider retains all rights, title, and interest in the Cloud Services, including any software, documentation, or intellectual property provided to Customer. Customer agrees not to copy, modify, or distribute any part of the services without Provider's prior written consent.
Provider respects the privacy of Customer's data and will process it in accordance with applicable privacy laws and the Provider's Privacy Policy. By using the Cloud Services, Customer agrees to the collection, use, and disclosure of their data as described in the Privacy Policy.
Customer agrees to adhere to the following Acceptable Use Policy ("Policy") while using the Cloud Services provided by Provider. By utilizing the services, Customer acknowledges and agrees to comply with the terms outlined in this Policy.
a. Prohibited Activities: Customer agrees not to use the Cloud Services for any improper, immoral, unlawful, or abusive purposes. Prohibited activities include, but are not limited to:

Compliance with Laws and Regulations: Customer shall ensure that they and their employees, agents, and any persons using the Cloud Services through them comply with all applicable laws and regulations. This includes, but is not limited to, laws relating to privacy, data protection, intellectual property, and telecommunications.
c. Responsibility for Content: Customer is solely responsible for the content transmitted, stored, or accessed through the Cloud Services. Customer agrees not to use the services to store or distribute any unlawful, infringing, or offensive content. Provider reserves the right to remove or disable any content that violates this Policy or is deemed inappropriate.
d. Reporting Violations: Customer agrees to promptly report any suspected violations of this Policy to Provider. Reports can be made through the designated contact channels provided by Provider. Customer acknowledges that failure to report violations may result in their own breach of this Policy.
e. Consequences of Violation: In the event of a violation of this Policy, Provider may take appropriate action, including but not limited to:
f. Cooperation with Investigations: Customer agrees to cooperate fully with Provider in any investigations or legal proceedings related to violations of this Policy. Customer understands that failure to cooperate may result in the suspension or termination of the Cloud Services.
g. Policy Updates: Provider reserves the right to update or modify this Policy at any time. Customers will be notified of any changes, and continued use of the Cloud Services after such changes constitutes acceptance of the modified Policy.
Provider shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the use or inability to use the Cloud Services. Provider's liability under this Agreement shall be limited to the fees paid by Customer for the affected services during the three months preceding the event giving rise to the liability.
Provider may terminate this Agreement and suspend access to the Cloud Services if Customer breaches any terms or conditions. Upon termination, Customer's right to access and use the services shall cease immediately.
This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].
This Agreement constitutes the entire understanding between Provider and Customer with respect to the Cloud Services and supersedes any prior agreements or understandings, whether written or oral.
By using the Cloud Services, Customer acknowledges that they have read, understood, and agreed to these terms and conditions.
